2024 is going to be a busy year for legislation and accompanying guidance.

Developments this month on codes of practice and guidance have been:

  • A draft Code of Practice on requests for flexible working has been published by ACAS and is awaiting parliamentary approval
  • The FRC has published a new UK Corporate Governance Code 2024 For those listed companies to whom the Code applies for financial years starting after 1 January 2025, the following should be noted:
    • Directors’ contracts which cover director remuneration should include malus and clawback
    • Annual reports should include a description of malus and clawback provisions including:
      • The circumstance in which malus and clawback provisions could be used
      • A description of the period for malus and clawback and why the selected period best suits the organisation
      • Whether the provisions were used in the last reporting period
  • The Government has updated its Guidance on holiday pay following reforms that took effect from 1 January 2024
  • In relation to the forthcoming duty to take reasonable steps to prevent sexual harassment, the EHRC have confirmed that there will be no separate statutory Code of Practice, but that it will update its current technical guidance on sexual harassment at work and will update its general Employment Code of Practice.
