Accidents at Work
Injuries arising from accidents at work can be caused by a lack of proper equipment, inadequate training and/or supervision or the failure by a colleague to do something that would have kept you safe and avoided the accident. If you suffer an accident at work you will be concerned about not only your health but by the financial worries and implications flowing from the accident.
You are entitled to investigate a claim against your employer in relation to the injuries and financial losses that you suffer from.
Even if you are self-employed you may still be able to claim compensation if for example you were a sub-contractor or if you were working in an area that was someone else’s responsibility. The employer will usually be insured and any claim for compensation would be handled by their insurance company. Rest assured that your employer is not entitled to dismiss you for bringing a claim against them.
Accidents in Public Places
Accidents can occur in public places or on private premises that you are visiting. The owner or occupier of those premises has a duty to ensure that visitors are kept reasonably safe.
If they have failed to take reasonable steps to ensure your safety then you could be entitled to receive compensation for any injuries you have suffered as a result of the accident. It is important that you seek proper advice as it is not always clear who is responsible for keeping the places or premises safe.
Our specialist lawyers will be happy to use their knowledge to assist you in investigating your claim properly and cost effectively.
Compensation for Criminal Injuries
If you or someone you know has been the victim of a crime of violence which has resulted in physical and/or psychological injury then you may be entitled to compensation from the Criminal Injuries Compensation Scheme. This Scheme is administered by the Criminal Injuries Compensation Authority (CICA) and it is possible to obtain compensation even if you do not know the identity of your assailant.
The CICA scheme can also make awards of compensation to certain family members/dependents of a person who has died as a result of a crime of violence.
The CICA scheme is governed by different rules to cases that proceed through the courts and if you are eligible for an award payments are made for different injuries depending upon the nature and severity of those injuries. This is known as the tariff. It is important that compensation is awarded under the correct tariff and our specialist lawyers will be able to advise and assist you so as to ensure that you receive the correct award from the CICA. You may also be entitled to a payment for financial losses such as loss of earnings in certain circumstances.
Industrial Disease
If you think you have developed a medical condition or disease as a result of your job and/or working conditions then you may be entitled to compensation.
For instance you may have been exposed to chemicals which have affected your skin or your breathing or you may have developed diseases such as mesothelioma or asbestosis due to exposure to asbestos. Employers have to take steps to protect the health and welfare of their employees. The extent of these obligations has changed over many years and so it is important that you seek advice from one of our specialist lawyers who will advise you what those responsibilities are and what time limits may apply to your case.
You may still be able to bring a claim even if the employer/company no longer exists and in certain situations you can bring a claim even if you were self employed.
Road Traffic & Cycling Accidents
If you have been injured in a road traffic accident either as a driver, a passenger, a cyclist or a pedestrian then it is likely that you will be entitled to claim compensation for your injuries and any financial losses that arise as a direct result of the accident.
If the person who caused the accident is not insured or you do not know their identity then you may still be able to claim compensation through the Motor Insurers Bureau. Such claims are subject to very specific rules and our specialist lawyers will be able to guide you through this process.
Sport & Leisure Claims
Unfortunately, many accidents occur during the course of everyday leisure and entertainment activities. These can range from slipping accidents in a bar or restaurant, to accidents on fairground attractions, go-karts, and ice-rinks, as well as injuries sustained during sports matches. We can help to put things right.
It is usually someone’s responsibility to keep a particular place safe for visitors. They should also ensure that health and safety regulations are complied with for organised events, shows and sporting activities. If you have had an accident, you may be able to bring a claim either against the owner of the premises or the organiser of an event. Our personal injury lawyers will fight to get you the compensation you deserve.
Product Liability
As a consumer, you are protected against defective products by the Consumer Protection Act 1987. If there is a defect in a product so that it is not as safe as you were entitled to expect and it causes you an injury or financial loss, you have the right to claim compensation. We will carry out investigations into the liability of the manufacturer and the extent of your injuries, and determine the losses you have suffered. We will seek compensation for your suffering, as well as financial losses such as lost earnings and medical expenses.
Whether you are having trouble with a medicine, an implant, or a piece of equipment, we have the expertise to help you. We have a wide range of experience and since 1987 have been at the forefront of the development of the law in this field having presented product cases for consumers at every level of court in England and Europe giving us a unique perspective on behalf of injured consumers.
Personal injury notable work
- Within the last twelve months we have attracted a number of catastrophic injury cases all of which are new. Three of these cases have values exceeding £4 million, they are children with traumatic brain/spinal cord injuries with significant values.
- Jane Goulding is well known nationally for her Claimant brain injury and spinal cord injury work for children and adults. At the current time she has eleven cases with values exceeding £3 million. Two cases settled last year one for £12 million and one with a capitalised value of over £12 million.
- Jane acted on a case where the claimant was seriously injured in a road traffic accident. There were complexities with regard to the accident circumstances, but eventually judgement was obtained against the defendant. Interim payments were obtained on a regular basis either voluntarily or by Court Order to enable a rehabilitation programme to be put in place to assist the claimant to assist him moving from residential accommodation into his own property, with a full care package, aids and equipments. This resulted in a final settlement in the case of £5 million (before the change in discount rate).
- Jane acted on a case where the file was transferred from another firm of solicitors, as the family had lost faith and trust in them. Her client had sustained serious brain injury as a result of an accident with a child. The previous firm had obtained a huge number of interim payments – so much that it was difficult to persuade the defendants to pay further interim payments which made obtaining rehab for this claimant difficult.
- A dependency claim arising out of a road traffic fatal accident, pleaded in excess of £1 million.
- A brain injury case arising from a fall into a pub cellar which settled in excess of £1 million.
- An accident at work causing significant foot and ankle injuries which settled for £261,000.
- A claim arising out of building site accident resulting in significant foot injuries and toe amputation which settled for £212,500.
- Secured compensation of £1 million for a client who suffered catastrophic brain injuries and physical injuries as a result of an accident at work. This enabled the client to adapt their home and have a bespoke care package in place to relieve the pressure from their relatives.
- Obtained a settlement in excess of £860,000 for a client who suffered permanent physical and psychological problems following a road traffic accident which included an award for alternative accommodation and adaptations.
- Secured an award in excess of £230,000 from the CICA for a childhood abuse case.
- Secured a compensation award in excess of £205,000 for a client who sustained physical injuries whilst abroad on a package holiday.
