What is involved with pre & postnuptial agreements?
Just as you would have a will to set out what should happen when you die, a nuptial agreement can set out your intentions if your marriage later breaks down. Whilst nuptial agreements have historically been an emotive topic to raise, many individuals are now choosing to have difficult conversations at the outset of their relationships or at other key events to regulate how they would want to deal with their assets.
A pre-nuptial agreement is a contract that is entered into prior to marriage.
A post-nuptial agreement is a similar contract that is entered into after marriage, most commonly as part of a wider wealth planning discussion or on a substantive sum being received by one party, for example, by way of inheritance or the sale of family business interest.
These agreements are a great option to help ease concerns about preserving your wealth; especially when remarrying or entering a civil partnership.
If properly drafted with property consideration of the safeguards, the courts will take these agreements into account if there is a future divorce and, whilst the Court have the final say, well drafted documents are being upheld by judges where they feel the outcome is fair in all the circumstances.
If entering into pre-nuptial agreement, it is important to finalise and sign it well ahead of your wedding date and at least 28 days before.
