About Caroline
Caroline is a Legal Director in the Restructuring and Insolvency Department. She has over 15 years’ experience of dealing with all aspects of contentious and non-contentious personal and corporate insolvency work.
Caroline passed the CPI professional insolvency exam in June 2008. She was one of only 6 lawyers to pass the CPI that year.
Throughout her career, Caroline has undertaken a wide range of personal and corporate contentious and non-contentious insolvency work. She acts for insolvency practitioners in respect of claims under the Insolvency Act 1986, general advisory work and transactional work for liquidators and administrators such as pre-packs and asset sale agreements. She also acts for a range of secured and unsecured creditors in relation to the enforcement of their rights and for directors in relation to the defence of insolvency act claims, disqualification proceedings and advice on their duties generally.
Caroline has been recognised in the Chambers UK Guide for Restructuring/Insolvency (Thames Valley). In previous Chambers’ editions she has been stated as being “….singled out by sources as a significant figure in the market, praised for her reaction speed, as well as her business acumen” and as having “….a very cool hand and a firm grip of things.” It was reported in the 2016 Chambers edition that: “Caroline Benfield undertakes the full range of insolvency work, including both contentious and non-contentious matters. “She’s very firm, quick to see the issues and acts in a way to bring about the recovery that I want,” comments an impressed client.”
Caroline has acted on a number of high profile and reported cases including Everitt v Budhram and Another [2009] EWHC 1219 (Ch) and Singh v Hicken [2018] EWHC 3277 (Ch) and Warlord Productions Limited (In Liquidation) which was featured on the BBC’s The One Show.

Notable work & expertise
- Acting for a director in connection with a number of claims being advanced against him by Liquidators concerning the company’s use of a tax avoidance scheme. The claims were settled following a without prejudice meeting and a tripartite agreement being entered into with the Liquidators and HMRC.
- Acting for Administrators in connection with their appointment, the sale of business and assets and applications to Court to extend the term of appointment.
- Acting for a Liquidator on a misfeasance and breach of duty claim arising from the use of a tax avoidance scheme and the removal of all reference to the company’s premises/tangible assets from the Company’s accounting records shortly before the company was placed into liquidation. The claims were assigned to a litigation funder and thereafter acting for the litigation funder in pursuing the claims which were settled at mediation.
- Acting for a Trustee in Bankruptcy in connection with the realisation of matrimonial property and issues concerning a Deed of Trust, the validity and implications of the same.
- Acting for a Trustee in Bankruptcy in connection matters concerning a wife’s claim to an interest in property by virtue of a resulting or constructive trust.
- Advising lenders on the enforcement of security, the options available to them and the process depending on the enforcement method that is adopted, including the appointment of receivers or administrations.
- Advising creditors on pursuing debtors, the options available to them and the process.
