About Kelly
Kelly Whittaker is a Managing Associate in the firm’s Dispute Resolution team having recently joined the dynamic and growing Bristol office. Recognised for her excellent procedural knowledge and dedication to the cases she works on, Kelly helps clients navigate complex disputes both externally and behind the scenes.
Having worked in industry before embarking on a legal career, Kelly has first hand experience of the commercial realities clients face. She is adept at balancing these competing demands including between risk mitigation, commercial objectives, management time and costs.
Kelly is recognised for her extensive experience in professional negligence actions having acted on some of the largest negligence claims in the High Court within the last 10 years. Her experience in this area is broad and includes claims against solicitors, surveyors/valuers, financial advisors and brokers, actuaries, auditors, accountants and engineers.
Alongside her professional negligence expertise, Kelly has advised extensively on company, shareholder and partnership disputes (including unfair prejudice petitions); contractual disputes across a wide range of sectors and on obtaining urgent injunctive relief (including freezing orders).
Kelly is well able to identify the issues central to a dispute and to convey these in a straightforward no nonsense manner ensuring parties focus on the real barriers to resolution. This serves clients especially well during the ADR process and has seen her successfully help settle many matters at, or shortly following, mediation.

- Acting for a specialist lender in respect of the negligent valuation of a shopping centre as security on a £17M loan.
- Advising a lender in respect of professional negligence claims against its monitoring surveyor in relation to two major developments valued in excess of £50M and in relation to work purportedly carried out during the Covid lockdown in 2020.
- Acting for a fund in a surveyor negligence claim regarding the overvaluation of two neighbouring mansions which stood as security for a £30m bridge-to-sell loan.
- Acting in claims against a pension scheme’s former actuarial and legal advisors for errors committed in the closure of a defined benefit scheme to future accrual and in implementing other changes.

- Advising a Hedge Fund in relation to a partnership dispute between its members including in relation to disclosure and the deployment of Technology Assisted Review in circumstances where the Fund’s document universe consisted of multi-millions of documents.
- Advising administrators in relation to a Norwich Pharmacal Order.
- Advising a Dutch Investment Fund on the interpretation of and potential claims arising out of a Dutch prepared Facility Agreement containing an English law and jurisdiction clause.
- Represented individual FCA regulated directors in claims made against them for dishonest assistance and unlawful means conspiracy including attending mediation as the client’s lead legal representative.
