Employment, Pensions & Immigration
Your business thrives on having the best people and retaining them!
Education is a unique and exciting sector in which to work. Businesses such as yours contribute enormously to the quality of education that is delivered in classrooms not just in the UK but also worldwide.
To achieve that, you employ many people within your workforce. You have expectations of them but in return, will be keen to make your business both a destination of choice when recruiting and then providing a desirable working environment to ensure motivation and commitment.
We work with education businesses to help them recruit and retain their workforce. Expertise is available across employment, pensions and immigration law.
Recent examples of our work includes drafting appropriate terms of supply for an education-specific recruitment agency; advising a client on the dismissal of an employee who was disqualified by association from working in education; drafting appropriate consultancy terms for creative workers in a film production company providing online learning resources; and assisting a national apprenticeship provider to restructure its workforce to fit its new model of online interactive learning and assessment.
Expert advice is available in relation to specific human resource issues including:
- Employment terms and conditions
- Classification of personnel as employees/workers and impact of IR35
- Directors and senior executive service agreements
- Employment policies
- Visa related matters including licence management
- Data protection

A special school operating in the private sector is sponsor to a free school in development. The project required the engagement of the principal of the existing school through a dual employment arrangement of a temporary nature. Freeths advised on the overall arrangement including developing the engagement terms and the understandings reached with the principal which assured a return to full time employment with the sponsor school at a later date.
A successful UK education business was looking to build its presence in middle and far east markets. This project required the engagement of an independent consultant. As always in arrangements of this kind care was required around the employment status of the individual. Taking the heads of terms for the appointment Freeths delivered a consultancy agreement suitable for the engagement with success based payment terms and carefully crafted confidentiality terms and restrictive covenants.
Having assisted in securing a sponsor licence for the business, Freeths has since contributed to the growth of the business by facilitating the retention and recruitment of overseas nationals.
The business had a number of vacancies in specialist digitech roles. They required a sponsor licence to enable them to recruit from overseas. This provided the business with opportunities to recruit from the international market and the international student market in the UK.
Freeths advised and assisted the business to secure their sponsor licence and have since managed the licence on the business’ behalf and secured all required visa clearance. This has enabled the business to realise the first stage of their growth plans.
